Chinese lawmakers debate on draft Civil Code

  China's top lawmakers on Wednesday made preliminary readings of the nation's first draft Civil Code. While they hail the draft law as milestone in legislative construction, they also question some of the wording and are suggesting expansion of some of its legislative scope.

  China's top legislator Li Peng attended the group discussions. Lawmakers say the draft of the first Civil Code in China marks an important step in building a socialist legal system. It offers more comprehensive protection of private property and more personal freedom.

  " The Civil Code represents a declaration of the rights of individuals and corporations. It clarifies in detail the civil rights of every person. It also lays emphasis on human dignity rights and offers comprehensive protection of private property and individual privacy. This will further promote the human rights cause in China in the 21st century," said NPC Standing Committee member Wang Jiafu.

  It also increases the compensation for mental or emotional suffering.

  The 216-page draft code is so far the most voluminous legislation in the country, with around 1200 clauses. It's expected to fill in gaps in current civil legislation, which although covering individual areas such as adoption and inheritance, is incomplete as no comprehensive legal framework in civil affairs exists yet.

  As they go over the draft word by word, the lawmakers put forward some suggestions for improvement.

  " I think the code should offer more protection to laborers, especially migrant workers. The current regulations are far from enough," said NPC Standing Committee member Wan Shaofen.

  Others suggest making amendments on contract law and the marriage law.

  As the code covers a wide spectrum of civil affairs, it's expected to take three to four years to win the final approval of the National People's Congress, China's top legislature.
